We all know that these are uncertain times and the risks of COVID-19 are not well understood. There is controversy among the experts on how the virus can spread and difficulty in scientifically determining whether anyone has a virus at any moment in time.

We all know that the Center for Disease Control and Prevention (CDC) has recommended that all businesses like ours remain closed, however, our governor Brian Kemp has assessed the risk and he feels that it is safe to open salons at this time. The Cherry Blossom Salon and its team are not experts in that risk analysis of COVID-19, but we are willing to open and provide salon services to you with the understanding that you are willing to accept the risk of contracting COVID-19.

In consideration for providing hair cuts and/or color services, by signing the questions and agreement, you agree to accept all responsibility for the risk that you may contract COVID-19 at any time. While we are taking your safety and that of our staff very seriously, by employing new safety and sanitation incentives, we cannot guarantee that any of these measures will completely protect you from contracting COVID-19.

RELEASE OF LIABILITY AND AGREEMENT NOT TO SUE, INDEMNIFICATION, HOLD HARMLESS, LIMITATION OF WARRANTY

In consideration for providing haircuts and coloring services, I agree that should I contract COVID-19 in the future at any time, I agree to indemnify and hold The Cherry Blossom Salon, its officers, agents, servants, employees, and land owners and their successors, and assign harmless from any and all claims for damages should I contract COVID-19 from this date forward.

I further agree that I will not file, nor cause to be filed, nor participate in any lawsuit against The Cherry Blossom Salon, its agents, servants, employees, and any other person who may be in any way connected with haircut and/or color services at The Cherry Blossom Salon including, but not limited to, the owners of The Cherry Blossom Salon, the staff with whom I am receiving services, their employees, and agents for injuries or death as a result of contracting COVID-19.

I agree that, if I take any steps to make a claim for damages against The Cherry Blossom Salon, its agents, employees, or any other released parties arising out of my receipt of haircut and/or color services during my visit to The Cherry Blossom Salon facilities, I shall be obligated to pay all attorney’s fees and costs incurred as a result of such claim.

I acknowledge that I can go elsewhere to have my hair cut and/or colored, and I acknowledge that The Cherry Blossom Salon is not the only hair salon where I could have my hair cut and/or colored at this time. By signing this agreement, I acknowledge that I am free to go to other salons who may not require my agreement to except responsibility for contracting COVID-19 and I choose to have haircut and/or color services at this time.

In addition, I agree if any dispute or claim relating in any way to the services provided by The Cherry Blossom Salon pursuant to the terms of this agreement will be resolved by binding, individual arbitration, rather than in court. I agree that arbitration shall be governed by the Federal Arbitration Act (FAA), including its procedural provisions in all respects.

By selecting the “I Accept” button, you are signing this Agreement electronically. You agree that your electronic signature is the legal equivalent of your manual signature on this Agreement. By selecting “I Accept” you consent to be legally bound by this Agreement’s terms and conditions.
